Terms of Service
The ground rules for using the Pixel Heist website, and how they relate to the written agreement we sign for client work.
Last updated October 23, 2026
These terms apply to your use of pixelheist.com (the “site”), which is operated by Pixel Heist, a web studio based in Buffalo, New York (“we” and “us”). By using the site you agree to them. If you do not agree, please do not use the site.
This site is not our services agreement
The site describes what we do. The work itself, including design, development, hosting, and maintenance, is provided under a separate written agreement or proposal that you and we both sign. Until then:
- prices, timelines, and examples on the site or in early conversations are general information, not a binding offer;
- sending a message through the contact form does not make you a client or create any obligation for either of us; and
- we have no duty to keep your message confidential until we agree to work together, so please do not send passwords, payment card numbers, or other sensitive information through the form.
If these terms conflict with a signed agreement for services, the signed agreement controls for that work.
Information only
Articles, case studies, and other content on the site are for general information. They are not legal, security, financial, or other professional advice for your situation. Results shown in case studies are examples and are not a promise of similar results for you.
Using the site
You agree not to:
- break, overload, or interfere with the site or the servers behind it;
- probe, scan, or test the site for weaknesses without our written permission;
- use bots or scripts to scrape the site at a harmful rate or to submit the contact form in bulk;
- send us spam, malware, or anything unlawful, threatening, or deceptive; or
- pretend to be someone else or misrepresent your connection to a person or business.
If you find a security problem in good faith, please tell us through the contact page before sharing it publicly.
Our content and your use of it
The text, design, code, images, and the Pixel Heist name and wordmark belong to us or to the people who license them to us. You are welcome to read the site, link to it, and quote short passages with credit and a link back. Please do not copy it wholesale, republish it, or use it in a way that suggests we endorse you. Work shown in our portfolio belongs to the clients who commissioned it and appears with their permission, and other companies’ names and logos belong to their owners.
What you send us
You are responsible for what you submit. By sending us a message you confirm you are entitled to share it, and you allow us to use it to respond to you and to keep reasonable records. How we handle personal information is described in our Privacy Policy.
Links to other sites
The site may link to websites we do not control. We are not responsible for their content or practices, and a link is not an endorsement.
No warranty
The site is provided “as is” and “as available.” We work to keep the information accurate and the site running, but we do not promise that it will be error-free, always available, or free of harmful components, and we disclaim all warranties to the fullest extent New York law allows.
Limit on our liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of your use of or inability to use the site. Our total liability for any claim relating to your use of the site is limited to $100. Nothing in these terms limits liability that cannot be limited under New York law, including for our own gross negligence or intentional wrongdoing. Limits on liability for paid services are set out in the written agreement for that work.
Accessibility
We want the site to be usable by everyone. If you run into a barrier, tell us through the contact page and we will do our best to fix it or provide the information another way.
Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. If you have a concern, please contact us first so we can try to settle it informally. If that does not work, any dispute relating to the site or these terms will be brought in the state or federal courts located in Erie County, New York, and you and we consent to the jurisdiction of those courts.
Changes
We may update the site or these terms from time to time. The date at the top shows when the terms last changed, and using the site after a change means you accept the updated terms.
General
If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. These terms and our Privacy Policy are the whole agreement between you and us about your use of the site.
